Crime and Non-punishment

The political scandals of 2017 are unlike anything seen before in American history. They include the  continued lack of indictment concerning the personal enrichment of a sitting Secretary of State via the provision of  key nuclear weapons material to a hostile nation; the unaddressed abuse of federal intelligence agencies to surveil political rivals in the 2016 campaign; and the apparently baseless charges of “Russian Collusion” against the current president being investigated (despite a lack of any substance to the allegation) by a politically biased special prosecutor who has hired supporters of the defeated candidate to do the research.

Liability for the acts in question are not limited to the direct perpetrators.  It extends to an entire network of federal officials who facilitated, through assistance, acquiescence, or neglect, the crimes in questions. Former FBI Director James Comey, despite the obvious nature of Clinton’s acts regarding both the uranium deal and her mishandling of emails, completely failed in his duty. Revelations that he prepared to exonerate the former Secretary of State before a formal investigation was even partially completed have provided even greater weight to the increasingly abundant body of evidence that he replaced his loyalty to the FBI and the American people with partisanship. Despite that reality, the media severely criticized President Trump for firing him.

While misdeeds by government are frequently exposed through the media, in this case, a very substantial portion of the press, through its refusal to provide honest journalistic practices, has become a party to them.

Some outlets, however, have done exceptional due diligence.  The Hill deserves particular credit for its ongoing expose of events surrounding Hillary Clinton’s uranium-related transactions with Moscow—and the complicity of Obama Administration officials. John Solomon and Alison Spann recently wrote: “the FBI had gathered substantial evidence that Russian nuclear industry officials were engaged in bribery, kickbacks, extortion and money laundering.”  Their report notes that there was a “violation of the Foreign Corrupt Practices Act,” according to official document.  “Russian nuclear officials had routed millions of dollars to the U.S. designed to benefit the Clinton Foundation during the time Secretary of State Hillary Clinton served on a government body that provided a favorable decision to Moscow, sources told The Hill…Rather than bring immediate charges in 2010, however, the Department of Justice (DOJ) continued investigating the matter for nearly four more years, essentially leaving the American public and Congress in the dark about Russian nuclear corruption on U.S. soil during a period when the Obama administration made two major decisions benefiting Putin’s commercial nuclear ambitions.”

Despite the Obama/Clinton Administration’s tenure-wide tilt towards Moscow, including giving Russia, for the first time in history, a lead in nuclear weapons, providing only weak sanctions in response to the invasion of Ukraine, and giving in to Putin’s demands about America’s missile defense, a myth was propagated that Trump’s campaign colluded with the Kremlin to win the 2016 election.  The desperate to find something—anything—to provide some substance to the charge has been an embarrassment both to those who first propagated the story and to those journalists who ignored the lack of evidence and continue to tout it.

Cheryl K. Chumley, writing for the Washington Times notes that “The tables have turned and what was once the media’s favorite message — President Donald Trump colluded with Russia to steal the election — has now grown silent. Apparently, it’s Bill and Hillary Clinton who’ve been doing the behind-scenes and suspicious dealings with Russia all along. Oh, and perhaps others in the Barack Obama administration, too.”

While official Washington has dragged its heels on indicting Hillary Clinton for any of the misdeeds she is implicated in, James Comey may have to worry about action from an unexpected direction.  Stephen Dinan  of The Washington Times  reports that Ty Clevenger, a New York attorney, has filed a grievance with his state’s bar association on the grounds that Comey lied to Congress and allowed the destruction of evidence in the Clinton email investigation. Clevenger’s actions could result in Comey losing his license to practice law.

Real Scandals, Ignored Scandals

In the media frenzy about Donald Trump’s locker-room style boorish comments, it’s not just Hillary Clinton’s role in covering up her husband’s sexual assaults, or her misdeeds in Benghazi, or her email violations, or her use of her position as Secretary of State for personal enrichment, or her role in selling uranium to the Russians that have been downplayed.

Intentional acts by federal agencies led by Obama appointees that engaged in unlawful partisan actions for the specific purposes of weakening the opposition in elections have been largely forgotten.

The partisan use of the IRS against conservative-leaning organizations from 2010—2012 came to light in 2013, and further abuses were revealed in 2014.

The House Oversight Committee notes that “Rather than cooperate with Congress, [IRS] Commissioner Koskinen obstructed the congressional investigations of the targeting program by: (1) allowing 24,000 emails relevant to the investigation, and covered by a congressional subpoena and internal preservation order, to be destroyed on his watch; and (2) failing to testify truthfully and providing false and misleading information to Congress.”

Despite howls of protest from the public and Congress, the tax agency has continued its attacks on organizations disagreeing with the Obama Administration, using various means to place private data from those groups in public. It has also been reported that the intrusive, excessive and harassing requests for irrelevant information from conservative groups continues.

Despite statements to the contrary, the partisan IRS assault was not the work of mere underlings. Investigations by the House Oversight Committee found that key officials knew of the actions taken, and may have directed them. Law360 reports  reports that “Public pressure from the Obama administration convinced the Internal Revenue Service to target conservative nonprofit groups for political activity, according to a House Oversight Committee report…  President Obama’s bully pulpit led to the Internal Revenue Service’s targeting of conservative tax-exempt applicants.”

Judicial Watch, which has been instrumental in revealing the wholesale abuse of federal agencies by the Obama Administration, continues to pay a price for exposing corruption in Washington.

Among the investigations performed by Judicial Watch was exposing hijinks by Obama appointees at the Government Services Administration (GSA).  But the federal agency didn’t hide in shame—they plotted their revenge.

The Washington Times explains: “Political operatives within the Obama administration wrongly punished the conservative legal group Judicial Watch, stripping it of “media” status and trying to force it to pay higher fees for its open records requests, the General Services Administration inspector general said in a letter released Thursday. The GSA botched several high-profile open records requests, delaying them for months while political appointees got involved, Inspector General Carol F. Ochoa said. The findings were released while the administration was facing charges of slow-walking open records requests for Hillary Clinton’s emails, as well as other requests.”

Wrongdoing by federal departments under the current White House is rampant across the spectrum.

David Rivkin and Andrew Grossman, writing in the Wall Street Journal have recently revealed yet another instance in which Obama appointees at federal agencies have power-grabbed and ignored Constitutional restraints in pursuit of the President’s agenda. “After Congress turned down President Obama’s request to enact a law regulating power plants’ greenhouse-gas emissions, the Environmental Protection Agency turned to the states—not with a request, but with instructions to carry out the president’s energy policy. …Even these approaches were not enough for the Obama administration to cajole the states to carry out its energy agenda. So it resolved to obliterate one of the last vestiges of the Constitution’s vertical separation of powers: the bar on federal commandeering of the states and their officials to carry out federal policy.”  The EPA’s actions will be reviewed in court.

The Federalist Society notes that “When the first Civil Service Reform Act passed in 1883, ‘good government’ reformers envisioned nonpartisan civil servants fairly administering the federal bureaucracy. From the vantage point of 2016, it is clear this dream has turned into a nightmare. Supposedly nonpartisan administrative agencies have often proven to be anything but. The executive branch increasingly treats agencies like the IRS and the DOJ not as impartial regulators, but as partisan weapons for intimidating political opponents.”

These actions have a direct impact on the 2016 election, but you wouldn’t know that from the major media.

Corruption Governs in Key State

Recent events in one of the nation’s largest states and in its largest city profoundly reflect upon the condition of American politics.

Since 2007, New York has experienced a bizarre period starting with the gubernatorial election held in 2006, in which Elliot Spitzer handily defeated his Republican challenger in a contest in which the state’s media overwhelming failed to provide equal coverage to the GOP candidate.  During the campaign, various state news outlets decided to call Spitzer the “governor presumptive,” dismissing the election out of hand.

Governor Spitzer quickly became ensnared in a sex scandal after being in office only a relatively short period of time. After resigning in its wake, he was succeeded in 2008 by his lieutenant governor, David Paterson, who also became politically wounded due to scandals of his own involving sexual affairs, drug use, and wrongdoing by key aides. He chose not to run for re-election, and was succeeded in 2011 by fellow Democrat Andrew Cuomo, who, in turn, is now being investigated by Preet Bharara, the U.S. Attorney for the Southern District of New York.

Since 2007, 11 state Assemblymembers, including 10 Democrats and one Republican, have left office, chose to not run again, or have been indicted due to criminal or ethical charges. Twelve State Senators, including 8 Democrats and four Republicans, have done the same.

The state’s federal elected officials have also faced troubles of their own. Former Rep. Anthony Weiner, a Brooklyn Democrat, was forced to resign in 2011 in the wake of revelations that he texted explicit photos of his genitals to several women. The state’s senior U.S. senator, Charles Schumer, Weiner’s mentor, has not been hit by these types of scandals and remains one of the most powerful men in Washington.  However, he has raised many eyebrows by his proposal to alter the First Amendment to allow restrictions on free speech related to campaign contributions.

And then, there is the Mayor of the nation’s largest metropolis.  New York City is the top target for terrorism, yet the federal government cannot include Democrat Mayor deBlasio in its planning because of his questionable past in which he assisted the Nicaraguan government at a time when it was assisting the Soviets.  It has also been found that his wife’s top aide has a live-in boyfriend who is a convicted murderer.
