Illegal Alien Impact on 2020 Election

The 2020 presidential elections are rapidly approaching, and the threat of compromising the integrity of the system due to illegal alien voting is again a grave concern. Discussion of illegal immigration issues, however, is rapidly met with false charges of racism.

Indeed, despite a stunning influx of up to 100,000 people crossing the southern border illegally each month, we are told that there is no crisis.

The crisis is more than just dollars and cents. A General Accounting Office study of 55,322 incarcerated illegal aliens  found that they were arrested at least a total of 459,614 times, averaging about 8 arrests per illegal alien. Nearly all had more than 1 arrest. Crimes included murder, assault, rape, fraud, burglary, counterfeiting, and drug offenses.  

There is not much of a mystery why Democrats are so eager to cover up the harsh realities of illegal immigration. Numerous analyses, including one by the Center for Immigration Studies, find that new immigrants consistently and solidly support Democrat candidates.  “A comparison of voting patterns in presidential elections across counties over the last three decades shows that large-scale immigration has caused a steady drop in presidential Republican vote shares throughout the country. Once politically marginal counties are now safely Democratic due to the propensity of immigrants, especially Latinos, to identify and vote Democratic.  A 2004 study by the Federation for American Immigration Reform  noted:

“There is evidence that noncitizens are being registered and casting votes, but due to the laxity in checking the eligibility of registrants and voters the full extent of the problem is not known. One of the most extensively documented cases of illegal voting was in California in 1996. Loretta Sanchez, a Democrat, defeated Republican incumbent Robert Dornan by 984 votes. Dornan called for an investigation of alleged illegal voting by noncitizens. According to Congressional Quarterly…’Task force Chairman [U.S. Representative] Vernon J. The enthusiasm evident in Democrat-controlled states to allow illegals to obtain drivers’ licenses is a key part of this drive to change the balance of political power. The Obama Administration took action which had the effect of increasing the likelihood of  illegals being able to register to vote. The Democratic Party has consistently opposed reasonable and necessary measures to prevent voter fraud.

In a 2015 letter to the Obama Administration, Ohio’s Secretary of State, Jon Husted noted: “…recent executive actions could jeopardize their integrity by making it much easier for people who are not U.S. citizens to illegally register and cast ballots. “The source of the problem is that the recent executive actions enable millions of non-U.S. citizens to obtain valid Social Security numbers and driver’s licenses. Under federal law, any person with a valid Social Security number or driver’s license can register to vote, so long as they attest to their eligibility to do so. As a result, the recent executive actions dramatically expand the opportunities for illegal voter registrations in Ohio and other states by non-citizen voters who have valid forms of identification and who willingly or negligently affirm their eligibility to vote. This problem is especially serious in the context of third-party voter registration drives, which are prevalent in Ohio and other states. Such drives occur outside of the presence of election officials who could explain that citizenship—not mere lawful presence—is a fundamental requirement for registering to vote and who can caution non-citizens against erroneous attestations. “In short, by enabling millions of non-citizens to access valid forms of the types of identification required to register to vote, the recent executive actions have increased the risk that non-citizens may illegally register to vote and vote in our elections…”

Election Fraud May Dominate 2020 Campaign, Part 2

A taste of the voter fraud controversy that may dominate the 2020 election was seen in Georgia. The hotly contested 2018 gubernatorial race between Republican Brian Kemp and Democrat Stacey Abrams featured charges of voter suppression by Abrams and Kemp’s claim that the Abrams campaign encouraged illegal voting.

The general position of the Democrat Party is that voter fraud doesn’t exist, or occurs in numbers too small to be relevant.

Daniel Green, writing for Front Page describes the Democrat perspective:  “Voter fraud doesn’t exist…If it does exist, they’ll stifle any attempt to protect our elections on the false grounds that they’re voter suppression. They’ll cry racism over any investigation of voter fraud. And if someone does get convicted of voter fraud, they get a pardon.

In November, reports the San Francisco Chronicle, California Governor Jerry Brown pardoned a Democratic former legislator who was found guilty four years ago of perjury and voter fraud. 

Hans Spakovsky, writing in the Free Speech & Election Law Practices  publication, emphasizes the problem of noncitizens registering to vote.  He reports that in a random sampling of 3,000 registrations in California’s 39th Assembly District, 10% contained phony addresses or were not U.S. citizens.

A number of states have attempted to attack fraudulent registrations by passing legislation requiring a valid ID to vote.  To the dismay of those dedicated to honest balloting, The Obama Justice Department responded with significant hostility to this measure.  Although almost all the reported fraud has aided hard-left Democrats, Kelly reports, even liberal United States Supreme Court Justice John Paul Stevens stated “There is no question about the legitimacy or importance of state’s interest in counting only eligible voters’ votes” in a 2008 case that upheld Indiana’s stringent ID law following a challenge by the Democrat Party and its allies.

 In testimony before the U.S. Senate’s Committee on Rules ad Administration, John Samples, The Cato Institute’s Director of the Center for Representative Government  stated that the Motor Voter Act “has made it difficult if not impossible to maintain clean registration rolls…the inaccuracy in the rolls caused by the Act has thrown into doubt the integrity of our electoral system.”

The Judicial Watch organization, in response to its August 9, 2011 Freedom of Information Act filing, received records which they described as detailing friendly communications between the Obama Justice Department and a former ACORN attorney now serving as Director of Advocacy for Project Vote.  The ACORN connection is ominous. 70 ACORN staff throughout 12 states were convicted of voter registration fraud; more than one third of the registrations that group submitted were found to be invalid.

From across the nation, news reports and studies verify the reality of voter fraud, campaign violations, and the growing influence of illegal aliens. Here’s a sampling:

  • The Obama Justice Department harassed states that seek to clean up voter registration roles and enforce state voter ID laws.
  • The Washington Post notes  “a group of undocumented immigrants…[knocked] on doors in Northern Virginia in support of Hillary Clinton and other Democratic candidates…The vote-seekers [were] some of the 750,000 recipients of temporary legal status under the Obama administration’s 2012 Deferred Action for Childhood Arrivals program. …‘All DACA recipients should take this on as an added responsibility, to change the power structure,’ said Luis Angel Aguilar, 28, who received his protected status in 2013 and is helping to coordinate the effort. ‘Our voices need to be heard”
  • Project Veritas reported:  NYC Democratic Commissioner of the Board of Elections Alan Schulkin stated at a  United Federation of Teachers party that there is widespread voter fraud in New York City…”Schulkin, a Democrat, said that to effectuate illegal voting, people are bussed to various polling sites. He places a blame on NYC’s radical-left Mayor de Blasio.  “He gave out ID cards. De Blasio. That’s in lieu of a driver’s license, but you can use it for anything. But, they didn’t vet people to see who they really are. Anybody can go in there and say I am Joe Smith, I want an ID card. It’s absurd. There’s a lot of fraud. Not just voter fraud, all kinds of fraud.”
  • A Science Direct white paper reported: We find that some non-citizens participate in U.S. elections, and that this participation has been large enough to change meaningful election outcomes including Electoral College votes, and Congressional elections. What may be an intentional refusal to update voter registration rolls allows a significant amount of fraud to be perpetuated. A Washington Times examination  of voters who moved out of the Nation’s capital to Prince George County in Maryland found that “The list of voters with names so unusual that there has been only one in the District and one in Prince George’s and who are listed as voting in both jurisdictions in the 2012 election is in the thousands. But this is where people on the Right and Left differ. Conservatives think fighting voter fraud is important; liberals and progressives don’t care …The Left promotes voter fraud by fighting electoral integrity laws in the courts, often enjoying great success… some officials are hostile to election observers from nonpartisan good government groups like True the Vote monitoring their polling precincts. The Left labels such attempts to keep elections honest ‘voter intimidation.’

Realclear politics notes that “One of the biggest voter frauds may be that there is no voter fraud, that laws requiring voters to have a photo identification are just attempts to suppress black voting. Reporter John Fund has written three books on voter fraud and a recent survey by Old Dominion University indicates that there are more than a million registered voters who are not citizens, and who therefore are not legally entitled to vote.”

Former Justice Department Attorney J. Christian Adams, with unique and specialized experience in the topic, provides extraordinary evidence.  Among the examples, as reported by Realclearpolitics:

These were illegal votes for Democrats…As for race-based “voter suppression,” amid all the political hysteria, how many hard facts have you heard? Probably none that supports that claim. Widely available free photo identification cards mean that poverty is no barrier to voting. Since blacks and whites both have to show photo I.D. for everything from cashing checks to getting on a plane, why has requiring a photo I.D. for voting caused such shrill outcries?”

Election Fraud May Dominate 2020 Campaign

The most contentious issue in the 2020 presidential election may not be illegal immigration, the growing threats from abroad, the federal budget, or any of the other myriad topics that dominate the news. The focus of arguments could be the conduct of the election itself.

 Democrats are attempting to dramatically alter the political landscape by various means, including eliminating most safeguards on illegal registration and voting, and giving felons voting rights.

Democrat opposition to anti-fraud measures such as picture ID has led to past embarrassment. In 2016, even as the party vehemently opposed those seeking to use that concept to combat illegal voting, the DNC required those seeking to gain entry to the floor of its presidential convention in Philadelphia to have such identification.

Current attempts to gain advantage at the ballot box center on legislative initiatives.

The New York State Assembly has introduced a state constitutional amendment that would allow for Election Day registration. Obviously, this allows no time to review actual eligibility to vote.

California has been a center of the pro-fraud movement. The state automatically registers anyone dealing with its Department of Motor Vehicles. The Wall Street Journal reports that the state DMV acknowledges that this has led to incorrectly registered 23,000 voters.  Since California allows illegals to get rivers licenses, that has presented a major threat to ballot integrity. The LA Times reported in April that over one million illegals have been granted drivers licenses.

The use of the controversial concept of “ballot harvesting” has led to major gains for California Democrats. The Independent Voters Network (IVN) describes what happened: “Ballot harvesting was used for the first time in November, and has clearly been advantageous to Democrats… The “minor” change was implemented when Gov. Jerry Brown signed the changes in AB1921 into law two years ago.  Here’s what it changed: In the past, California allowed only relatives or those living in the same household to drop off mail ballots for another voter. Ballot harvesting allows anyone, even a paid political campaign worker, to collect and return ballots — ‘harvesting’ them. In Orange County alone, every House seat went Democratic. The chairman of the county Republican Party, Fred Whitaker, said: ‘…the number of Election Day vote-by-mail dropoffs was unprecedented — over 250,000, this is a direct result of ballot harvesting allowed under California law for the first time. That directly caused the switch from being ahead on election night to losing two weeks later.’

In interviews, Speaker Paul Ryan said ballot harvesting ‘defies logic…We were only down 26 seats the night of the election and three weeks later, we lost basically every California race’

“In August, a federal judge in Arizona upheld the ballot harvesting ban in Arizona. HB 2023 makes it a felony for anyone other than a family member, caretaker or postal worker to collect another person’s ballot and turn it in to election officials. Supporters of the measure defend it as a safeguard against potential ballot tampering.Eighteen states have outlawed ballot harvesting, and on the website Ballotpedia, Ballot harvesting is listed under the section ‘Voter Fraud.’”

Allowing a partisan campaigner to collect ballots is an open invitation to fraud.

Another strategy pursued by Democrats to enhance their election chances has been giving convicted felons the right to vote. A study by The Annals of the American Academy of Political and Social Sciencefound that the majority of felons register as Democrats.

The National Conference of State Legislatures (NCSL) notes that “ It has been common practice in the United States to make felons ineligible to vote, in some cases permanently…”                                       

An NCSL study found that:

  • In Maine and Vermont, felons never lose their right to vote, even while they are incarcerated. 
  • In 14 states and the District of Columbia, felons lose their voting rights only while incarcerated, and receive automatic restoration upon release.
  • In 22 states, felons lose their voting rights during incarceration, and for a period of time after, typically while on parole and/or probation. Voting rights are automatically restored after this time period. Former felons may also have to pay any outstanding fines, fees or restitution before their rights are restored as well.

In 12 states felons lose their voting rights indefinitely for some crimes, or require a governor’s pardon in order for voting rights to be restored, or face an additional waiting period after completion of sentence (including parole and probation) before voting rights can be restored.

Political Motives Behind Weakened Border Enforcement

U.S. Representatives Pramila Jayapal (D-WA) , Mark Pocan (D-WI) and Adriano Espaillat (D-NY)- have introduced the “Establishing a Humane Immigration Enforcement System Act.” The legislation would convene a “commission of experts” to provide a roadmap for Congress to implement an altered, and presumably weaker, form of  immigration enforcement. The legislation is cosponsored byRepresentatives Earl Blumenauer (D-OR), Yvette D. Clarke (D-NY), Jim McGovern (D-MA), José E. Serrano (D-NY), Adam Smith (D-WA), and Nydia M. Velázquez (D-NY).

The bill provides few specific details on what ICE should be replaced with.  That’s probably intentional.

To a significant extent, the measure may be more of a rallying cry to the left. It also appears to be a bid to increase the potential vote on the Democrat line, since most newcomers to the U.S. tend to vote for that party at least until they become vested in the American economic system.

Peter Beinart, who describes himself as a liberal, provided  this analysis in A 2017 Atlantic article of the radical Democrat position  :

“Between 2008 and 2016, Democrats became more and more confident that the country’s growing Latino population gave the party an electoral edge. To win the presidency, Democrats convinced themselves, they didn’t need to reassure white people skeptical of immigration so long as they turned out their Latino base. ‘The fastest-growing sector of the American electorate stampeded toward the Democrats this November,’ Salon declared after Obama’s 2008 win. ‘If that pattern continues, the GOP is doomed to 40 years of wandering in a desert.’…As the Democrats grew more reliant on Latino votes, they were more influenced by pro-immigrant activism….Alongside pressure from pro-immigrant activists came pressure from corporate America, especially the Democrat-aligned tech industry, which uses the H-1B visa program to import workers. In 2010, New York Mayor Michael Bloomberg, along with the CEOs of companies including Hewlett-Packard, Boeing, Disney, and News Corporation, formed New American Economy to advocate for business-friendly immigration policies. Three years later, Mark Zuckerberg and Bill Gates helped found FWD.us to promote a similar agenda.’”

The blatantly partisan move by Democrats, and their increased use of soft violence and intimidation against opposition figures has met with stiff reaction. Paul Crookston, writing in the Free Beacon  reports that “Mitch McConnell (R., Ky.) said…he will not be intimidated by protesters who confront him calling for the abolition of U.S. Immigration and Customs Enforcement.” McConnell had recently been accosted by demonstrators shouting “Abolish ICE” at a restaurant in Kentucky. The Senate Majority leader noted that several key Democrat senators, including Kirsten Gillibrand, (NY) Elizabeth Warren (Mass.) and Kamala Harris (Calif.) were essentially demanding “open borders.”

A FAIRUS study outlines the role noncitizens play in U.S. elections, a role primarily strengthening Democrats:

“…there is evidence that both foreign nationals who are lawfully present in the United States and illegal aliens have voted in recent elections. … noncitizens have been discovered on voter registration rolls in both Virginia and Pennsylvania…Several past elections – for the presidency and other offices – have been extremely close. Accordingly, ballots cast by noncitizen voters have the potential to improperly alter the outcome of elections…laws requiring voting registrants and voters to establish proof of citizenship have been repeatedly challenged in recent years.  The most frequent objections to these reasonable measures are that voter fraud is a ‘myth’ and that voter ID requirements will unreasonably interfere with the right to vote. However, these claims seem patently unreasonable given that there have been numerous reports of unlawful voting by aliens but no virtually no reports of voters being disenfranchised.

“Marking a disturbing new trend, several municipalities…have begun allowing noncitizens to vote in town…State efforts to extend the franchise to noncitizens undermine the rule of law; blur the distinctions between citizens and noncitizens; and render U.S. elections susceptible to both fraud and foreign influence… In 2014, a study released by a team of professors from Old Dominion University and George Mason University estimated that approximately 6.4 percent of noncitizens voted In the 2008 presidential election. They also surmised that 2.2 percent voted in the 2010 midterm election.20 In addition, the study estimated that 80 percent of noncitizens who appeared to have voted cast their ballots in favor of one party. Noncitizens are believed to have voted in these elections in numbers great enough to have affected the outcome.”

Non-citizen Voting Evidence Expands

The news that Victor David Garcia Bebek, a noncitizen in Kansas, has pleaded guilty to three counts of voting unlawfully in 2012 and 2014 has implications far beyond a single state or a single incident

Denial of voter fraud has been a mantra of the left for some time, even as reports of clear and evident voting and voting registration fraud have become available.  Columnist Pamela Gellar has noted that “Voter fraud is rampant. Were the full extent of it known, I am sure it would shock the world.”

It is not surprising that the prosecution arose in Kansas. The “Sunflower State” is the only one of the fifty that empowers its secretary of state to prosecute election law violations.

The Obama Administration engaged in consistent and significant efforts to prevent the detection and prosecution of these crimes. Leftist politicians are keenly aware that new arrivals to the U.S., especially those that come illegally, vote Democrat.

Indeed, not only did the Obama White House fail in its duty to prevent violations of the law, it actually encouraged this activity by moving with great force to foster the conditions that allow voter fraud to occur.  J. Christian Adams, an attorney in the voting rights section of the Department of Justice, has written that the Obama Administration killed any moves to address voter fraud, and specifically hired attorneys “whose main career experience was in subverting voting laws…”  Harassing state officials who sought to insure accurate balloting by imposing identification requirements, and cleaning up voter rolls, became an obsession of the Obama’s Justice Department

Hans Von Spakovsky, writing in National Review last year as the Presidential contest moved into gear,  described how “The U.S. Election Assistance Commission (EAC) had moved to allow Kansas, Georgia, Alabama, and Arizona to enforce their proof-of-citizenship voter-registration requirement. The Obama Justice Department moved against the action, part of its ongoing goal of allowing illegals to vote and to allow other voting violations to occur.”

Also in 2016, the True the Vote organization pleaded unsuccessfully with the DOJ to move against a clear-cut caser of alien voting. A letter to the U.S. Attorney for the Western District Annette L. Ohio’s Secretary of State, Jon Husted wrote a letter  to the White House protesting Obama’s policy, stating:

“I write regarding the consequences the recent Immigration Accountability Executive Actions may have on the administration of federal and state elections. Consistent with federal and state law, states are responsible for ensuring the integrity of our elections. As a swing state with access to voting that is already expansive, Ohio takes this responsibility very seriously. In spite of our diligence maintaining accurate voter registration rolls, however, the recent executive actions could jeopardize their integrity by making it much easier for people who are not U.S. citizens to illegally register and cast ballots…

“The source of the problem is that the recent executive actions enable millions of non-U.S. citizens to obtain valid Social Security numbers and driver’s licenses. Under federal law, any person with a valid Social Security number or driver’s license can register to vote, so long as they attest to their eligibility to do so.1 As a result, the recent executive actions dramatically expand the opportunities for illegal voter registrations in Ohio and other states by non-citizen voters who have valid forms of identification and who willingly or negligently affirm their eligibility to vote. This problem is especially serious in the context of third-party voter registration drives, which are prevalent in Ohio and other states. Such drives occur outside of the presence of election officials who could explain that citizenship—not mere lawful presence—is a fundamental requirement for registering to vote and who can caution non-citizens against erroneous attestations.

In our small sample of just eight Virginia counties who responded to our public inspection requests, we found 1046 aliens who registered to vote illegally. The problem is most certainly exponentially worse because we have no data regarding aliens on the registration rolls for the other 125 Virginia localities. Even in this small sample, when the voting history of this small sample of alien registrants is examined, nearly 200 verified ballots were cast before they were removed from the rolls. The poor condition of voter registration rolls across the U.S. is also illustrated by what the Daily Signal calls the “Zombie Voter” problem, where numerous votes are cast in the names of individuals who have died. Obama’s immigration strategy hit by Court

Yesterday’s ruling from the 5th circuit refuting President Obama’s drive to enforce executive actions giving semi-legal status as well as work permits to a vast number of illegal immigrants is the latest volley against an increasingly aggressive move to radically change the balance of power in American elections.

The battle lines in this fight for dominance of the American political scene have been drawn and the fight is becoming increasingly intense. On the one hand are most states, local law enforcement officials, and voter integrity groups that seek to insure that only U.S. citizens vote. On the other are progressives who, noting that after the once popular Barack Obama leaves office American voter patterns will return to a more conservative path, seek to bring a new group of voters, legally or illegally, to the ballot box to improve their future electoral chances.

The New York Times reports that “a group of former aides to President Obama and President Bill Clinton is pledging to counter by spending up to $10 million on a push to make voter registration automatic whenever someone gets a drivers’ license.” The drive is managed by an organization called iVote. The new voters targeted are young, poor and in many cases aliens, groups that vote solidly Democrat.

Attaching voter registration to drivers’ licenses is the most expeditious way of getting aliens, legal and illegal, unlawful access to the ballot box. Attempts are geared towards getting the new illegal voters registered in time for the 2016 election. The numbers that would be included in this measure are overwhelming.  In California alone, up to 500,000 licenses have been given to illegal immigrants.

In September, the Times also reports, “White House officials announced the start of a nationwide campaign …to encourage legal immigrants to become American citizens, which could add millions of voters to the electorate in time for the presidential election next year.”

National Review notes that “Even if a tiny fraction [of immigrants] vote, they easily could tip an election. A notable number of legal immigrants already vote illegally in elections. A recent Cooperative Congressional Elections Study calculated that 6.4 percent of non-citizens in the U.S. voted in 2008 and 2.2 percent of them did so in 2010.”

The proportion of immigrants to the general population in many areas is at near-historic levels. The New York Daily News reports that NY State comptroller Thomas DiNapoli found that “Immigrants…account for 37% of the city’s population, the largest share in 100 years. The city’s immigrant population — 3.1 million — has more than doubled since 1970… immigrants account for 43% of the city’s workforce, up from 31% in 1990.”  That figure, at a time when unemployment remains high, is a major affront to the many Americans that are urgently seeking employment.

Politico  Outlines how immigrants can swing the election even without casting unlawful votes:

“Legal immigrants—along with other noncitizens without the right to vote—may pick the 2016 presidential winner. Thanks to the unique math undergirding the Electoral College, the mere presence of 11-12 million illegal immigrants and other noncitizens here legally may enable them to swing the election from Republicans to Democrats…The census counts illegal immigrants and other noncitizens equally with citizens. Since the census is used to determine the number of House seats apportioned to each state, those states with large populations of illegal immigrants and other noncitizens gain extra seats in the House at the expense of states with fewer such ‘whole number of persons.’ This math gives strongly Democratic states an unfair edge in the Electoral College.”

Illegal voting danger increases

California’s new motor voter law provides a significant example of how voter fraud has become institutionalized in some locations. The measure, recently signed by Governor Jerry Brown, provides automatic voter registration upon obtaining or renewing a driver’s licenses at the Department of Motor Vehicles for those qualified—but there is little effort to insure that only those qualified are registered. There is no required form to be filled out.

Since California allows illegals to obtain drivers licenses, it is inevitable that many will register to vote.  Clearly, Democrat Governor Brown has a vested interest in this occurring, since the policies of his party are particularly attractive to illegal immigrants.

Rasmussen reports that “Fifty-three percent (53%) of Democrats think tax-paying illegal immigrants should have the right to vote. Twenty-one percent (21%) of Republicans and 30% of voters not affiliated with either major political party agree.”

According to a Fox News Latino report, the state has already issued half a million licenses to illegals in the past nine months.

As significant as that number is, particularly in a state with so many electoral votes in the coming presidential election, it’s only the tip of the iceberg when viewed nationally. National Review notes that:

“President Obama’s recent executive orders granting provisional legal status to an estimated 5 million illegal aliens will likely allow an indeterminate number of them to cast ballots in elections across the United States — and it’s hard to see how it won’t affect the outcome of some number of close elections. Amnestied illegal aliens are now eligible to receive Social Security numbers and, in many cases, drivers’ licenses. Since the vast majority of states don’t require individuals to present proof of citizenship to either register or vote, and given the Obama administration’s zealous promotion of motor-voter registration and declared refusal to enforce Section 8 of the National Voter Registration Act (ensuring that only eligible individuals vote), it’s certain that appreciable numbers of amnestied illegal aliens will be able to vote.”

The measure has been blocked by the courts as a result of the lawsuits brought by 26 states, but given the Administration’s tendency to disregard laws it disagrees with, and the politicization of the Justice Department, there is little confidence that wrongful acts will be prevented. J. Christian Adams, who served for 5 years in the voting rights section of the DOJ, noted in his book “Injustice” that under President Obama “the very government department responsible for protecting voting rights and enforcing equal protection has been overrun by radicals bent on furthering a fringe political agenda…”

Judicial Watch’s Tom Fitton maintains that one organization, La Raza, promotes unlawful voting by illegal aliens as part of its wider goal of gaining greater Mexican influence in the U.S. Southwest.

The Judicial Watch organization, in response to its August 9, 2011 Freedom of Information Act filing, has received records which they describe as detailing friendly communications between the Justice Department and a former ACORN attorney now serving as Director of Advocacy for Project Vote.  The ACORN connection is ominous. 70 ACORN staff throughout 12 states were convicted of voter registration fraud; more than one third of the registrations that group submitted were found to be invalid.

Several observers notes that to become a U.S. citizen, at least a minimal proficiency in English is required. Logically, then, with the possible exception of those living on Native American (Indian) reservations, there is no logical reason for mandating the printing of ballots in any language other than English, other than assisting those who do not have the legal right to cast votes.

Proenglish notes that “in 1975, Congress greatly expanded the Voting Rights Act’s original intent by inserting special protections for ‘language minorities.’ The language minorities singled out for protection under Section 203 of the Act were: American Indians, Asian Americans, Alaskan Natives, and citizens of Spanish Heritage. For the first time in our history, states and counties with substantial populations of these protected language minorities were required to provide ballot and election materials in languages other than English.” The organization notes thatThe United States is an English-speaking country in which almost all citizens speak, read, and understand the English language. Since 1907, the United States has required immigrants to learn English in order to naturalize and acquire the rights of citizenship, including the right to vote in federal elections. This is entirely appropriate for a nation whose Constitution and founding documents are written entirely in the English language. Therefore, forcing state and local governments to print foreign-language ballots for citizens who are already required to read and understand English is both redundant and wasteful.

“The only logical rationale for the mandatory provision of ballots and voting materials in other languages is to facilitate and encourage voting by non-citizens – a violation of federal law. Thus, bilingual ballots debase the meaning of citizenship, encourage voter fraud, and undermine the integrity of the naturalization process by eliminating an incentive for immigrants to learn English.”
