Although these advancements are creating new opportunities, new risks for space-enabled services have emerged. Having seen the benefits of space-enabled operations, some foreign governments are developing capabilities that threaten others’ ability to use space. China and Russia, in particular, have taken steps to challenge the United States:

• Chinese and Russian military doctrines indicate that they view space as important to modern warfare and view counterspace capabilities as a means to reduce U.S. and allied military effectiveness. Both reorganized their militaries in 2015, emphasizing the importance of space operations.

 • Both have developed robust and capable space services, including space-based intelligence, surveillance, and reconnaissance. Moreover, they are making improvements to existing systems, including space launch vehicles and satellite navigation constellations. These capabilities provide their militaries with the ability to command and control their forces worldwide and also with enhanced situational awareness, enabling them to monitor, track, and target U.S. and allied forces.

• Chinese and Russian space surveillance networks are capable of searching, tracking, and characterizing satellites in all earth orbits. This capability supports both space operations and counterspace systems.

• Both states are developing jamming and cyberspace capabilities, directed energy weapons, on-orbit capabilities, and ground-based antisatellite missiles that can achieve a range of reversible to nonreversible effects. Iran and North Korea also pose a challenge to militaries using space-enabled services, as each has demonstrated jamming capabilities. Iran and North Korea maintain independent space launch capabilities, which can serve as avenues for testing ballistic missile technologies. The advantage the United States holds in space—and its perceived dependence on it—will drive actors to improve their abilities to access and operate in and through space. These improvements can pose a threat to space-based services across the military, commercial, and civil space sectors

Although the United States and the former Soviet Union dominated early space activities, space capabilities have proliferated over the past six decades as technological and cost barriers have fallen. These capabilities provide important support to many of society’s daily activities, including communications, navigation, financial transactions, and weather monitoring. As of 2018, over 1,800 active satellites are on orbit, which are owned and operated by over 50 countries and multinational organizations.1 Nine countries and one international organization can independently launch spacecraft: China, India, Iran, Israel, Japan, Russia, North Korea, South Korea, the United States, and the European Space Agency (from French Guiana).

Some actors are seeking ways to deny the effectiveness of the United States, having witnessed more than 25 years of U.S. military successes enabled by space capabilities.8 China and Russia, in particular, are developing a variety of means to exploit perceived U.S. reliance on space-based systems and challenge the U.S. position in space.9 Iran and North Korea also have demonstrated some counterspace capabilities that could pose a threat to militaries using space-based services.

While China and Russia are developing counterspace weapons systems, they are promoting agreements at the United Nations that limit weaponization of space. Their proposals do not address many space warfare capabilities, and they lack verification mechanisms, which provides room for China and Russia to continue to develop counterspace weapons.10,11 The 1967 Outer Space Treaty prohibits placing weapons of mass destruction on orbit and on any celestial body and it prohibits using celestial bodies for military bases, testing, or maneuvers. 107 states have ratified the treaty, including the United States, China, North Korea, and Russia. Iran is one of 23 states that have signed, but not ratified, the treaty.

U.S. Manned Space Program Returns

Towards the base of the capsule and contained within the nose cone are the Draco thrusters, which allow for orbital maneuvering.

Dragon’s trunk carries unpressurized cargo and supports the spacecraft during ascent. The trunk remains attached to Dragon until shortly before reentry into Earth’s atmosphere.

Astronauts Robert Behnken and Douglas Hurley will fly on SpaceX’s Crew Dragon spacecraft, lifting off on a Falcon 9 rocket at 4:32 p.m. EDT May 27, from Launch Complex 39A in Florida, for an extended stay at the space station for the Demo-2 mission. The specific duration of the mission is to be determined.

As the final flight test for SpaceX, the mission will validate the company’s crew transportation system, including the launch pad, rocket, spacecraft, and operational capabilities. This also will be the first time NASA astronauts will test the spacecraft systems in orbit.

Behnken will be the joint operations commander for the mission, responsible for activities such as rendezvous, docking and undocking, as well as Demo-2 activities while the spacecraft is docked to the space station. Hurley will be the spacecraft commander for Demo-2, responsible for activities such as launch, landing and recovery. He was selected as an astronaut in 2000 and has completed two spaceflights. Lifting off from Launch Pad 39A atop a specially instrumented Falcon 9 rocket, Crew Dragon will accelerate its two passengers to approximately 17,000 mph and put it on an intercept course with the International Space Station. The spacecraft is designed to do this autonomously but astronauts aboard the spacecraft and the station will be diligently monitoring approach and docking and can take control of the spacecraft if necessary.

After successfully docking, Behnken and Hurley will be become members of the Expedition 63 crew. They will perform tests on Crew Dragon in addition to conducting research and other tasks with the space station crew.

Although the Crew Dragon being used for this flight test can stay in orbit about 110 days, the specific mission duration will be determined once on station based on the readiness of the next commercial crew launch. The operational Crew Dragon spacecraft will be capable of staying in orbit for at least 210 days as a NASA requirement.

Upon conclusion of the mission, Crew Dragon will autonomously undock with the two astronauts on board, depart the space station and re-enter the Earth’s atmosphere. It will splashdown just off Florida’s Atlantic Coast, and the crew will be picked up at sea by SpaceX’s Go Navigator recovery vessel and return to Cape Canaveral.

The mission will also lay the groundwork for future exploration of the Moon and Mars starting with the agency’s Artemis program, which will land the first woman and the next man on the lunar surface in 2024.

China’s Doublespeak

Words matter. Perspective matters. Four years ago, China abruptly changed the name of its major international economic development strategy from “One Belt, One Road” (条皮带一条)to the “Belt and Road Initiative,”(带一路议)or BRI. Officials in the CCP believed the connotation of “one” could be misunderstood by foreign audiences. Curiously, though, the Chinese language version remained unaltered and still is the standard naming protocol used today by Chinese state media. Understanding the reasons behind the change in moniker, and the scope of Chinese BRI activities, reveals a lot about how the Chinese leadership operates.

Hegemonic power, global leadership, and BRI all are terms found in senior Chinese officials’ vernacular. The concepts of misinformation, disinformation, and propaganda also are found in the CCP toolkit. Western policy makers need to understand China’s expertise in manipulating the world to achieve its end goals. The meaning behind the vague terms that China employs to showcase its global ambitions is revealing. So are the differences in interpretation between the words presented to the domestic Chinese population and those chosen for foreign audiences. To analysts it delineates the gap between the CCP leadership’s goals and what level of interference Beijing believes foreign governments will tolerate.

After Chinese princeling, CCP Chairman, and President, Xi Jinping consolidated power in 2012, and ended term limits on the presidency, he officially emerged as the most powerful leader in the country since Mao Zedong. A year later he announced his “One Belt, One Road” initiative with the objective of using his elevated platform to further China’s global ambitions. Some critics view the soft power policy as an attempt to turn China into a global hegemon, while others choose to believe in China’s benign beneficence. 

Despite which perspective developing countries hold it is becoming evident the BRI is not the panacea as originally portrayed by Beijing. China’s direct foreign investment in infrastructure development has saddled many small, poor nations with record high debt, created political instability, waste, unused expensive infrastructure (often using low quality construction materials) and fostered corruption among greedy local politicians. Unlike the United States, China willingly overlooks human rights and other abuses in the recipient countries under the guise of its official “non-interference” policy. The FORCE Act will greatly strengthen the United States’ position in the Indo-Pacific, allowing us to block China’s goals of regional dominance, and ultimately, competition with the United States,” said Cotton.

The measure would provide $6.1 billion to regain the advantage in the Indo-Pacific region, $9.2 billion in capability increases for great power competition, $11.0 billion for mitigating coronavirus impacts to procurement programs, $3.3 billion for mitigating coronavirus impacts to defense industrial base, $1.5 billion for hospital ship recapitalization, and $12 billion to enhance national resilience and critical infrastructure.

 In another response to Beijing, a number of states’ attorneys general are seeking to sue Beijing for damages caused by the Communist nation’s malfeasance in the COVID-19 matter.

Republican attorneys general are holding communist China accountable for its deadly actions.”

The letter by the 18-state coalition concludes, “We must all hold China accountable for the devastation and destruction caused by COVID-19. Tens of thousands have died from the virus and millions have lost their jobs. Countless businesses, both big and small, will perish and our states will grapple with tough economic decisions for years to come.”

Missouri Attorney General Eric Schmitt filed the first lawsuit against China on April 21 citing a “campaign of deceit” on the part of the Chinese related to the outbreak of the pandemic.

The lawsuit states that “An appalling campaign of deceit, concealment, misfeasance, and inaction by Chinese authorities unleashed this pandemic. During the critical weeks of the initial outbreak, Chinese authorities deceived the public, suppressed crucial information, arrested whistleblowers, denied human-to-human transmission in the face of mounting evidence, destroyed critical medical research, permitted millions of people to be exposed to the virus, and even hoarded personal protective equipment—thus causing a global pandemic that was unnecessary and preventable. Defendants are responsible for the enormous death, suffering, and economic losses they inflicted on the world, including Missourians, and they should be held accountable.”

 In addition, Mississippi Attorney General Lynn Fitch announced her decision to also file a lawsuit holding China accountable.

RUSSIA

The United States and our allies face an increasingly threatening and complex strategic environment. Russia and China are increasing the role of nuclear weapons in their strategies and have been increasing the size and sophistication of their nuclear forces. Rogue regimes like North Korea and Iran are destabilizing regions through their pursuit of nuclear weapons and ballistic missile programs.

Russia is modernizing an active stockpile of up to 2,000 non-strategic nuclear weapons employable by ships, planes, and ground forces.

CHINA

Over the next ten years, China is expected to at least double the size of its nuclear stockpile while implementing the most rapid expansion and diversification of its nuclear arsenal in its history. China is developing, testing, and fielding new generations of land-based ballistic missiles, increasing the range of its submarine-launched ballistic missiles, and pursuing a new bomber. Further, it is expending significant resources on advanced nuclear-capable systems and hypersonic vehicles.

NORTH KOREA

North Korea continues its illicit pursuit of nuclear weapons and missile capabilities in direct violation of United Nations Security Council resolutions. It has conducted increasingly sophisticated nuclear and ICBM flight tests, which pose a threat to the U.S. homeland and our allies.

IRAN

Iran has developed and fielded a substantial arsenal of ballistic missiles that can strike targets throughout the region. These ballistic missiles are a key component of Iran’s efforts to dominate its region of the world and intimidate U.S. allies and partners. Additionally, Iran’s current attempts to launch a space vehicle could provide valuable information that would aid its effort to develop an ICBM capability.

POLICY

While the United States has taken concrete steps to reduce the role and number of nuclear weapons in our national security strategy, others have increased the number of nuclear weapons they field and have increased the role of nuclear weapons in their security strategies. Until nuclear weapons can prudently be eliminated from the world, the United States must maintain a credible nuclear force by modernizing where necessary to ensure the security of the United States, our allies, and our partners. The 2018 Nuclear Posture Review reaffirms that the United States will pursue a safe, secure, survivable, and effective nuclear deterrent while simultaneously pursuing nuclear nonproliferation and arms control efforts. The highest U.S. nuclear policy and strategy priority is to deter potential adversaries from nuclear attack of any scale. The United States would only consider employing nuclear weapons in the most extreme circumstances to defend our vital interests and those of our allies and partners.

STRATEGY

The three legs of the U.S. nuclear Triad are complementary, with each component offering unique strengths. Together, the Triad ensures the United States can effectively withstand and respond to any attack.

With 400 ICBMs, no adversary can disarm the U.S. nuclear deterrent without attacking hundreds of targets simultaneously.

 U.S. nuclear weapons deter nuclear and strategic non-nuclear aggression, including chemical, biological, and large-scale conventional attacks. Although still reliable and credible, our current delivery systems, weapons, command and control systems, and infrastructure are rapidly aging into obsolescence. 

The FY 2021 Budget Request funds all critical DoD nuclear modernization, sustainment, and operational requirements, helping to ensure modern replacements will be available before the nation’s Cold War legacy systems reach the end of their extended service lives. 

Delays in funding for replacement systems will adversely impact military operations and undermine the deterrence mission.

PROGRAMS

COLUMBIA-Class Ballistic Missile Submarines will replace the nearly 40-year-old OHIO-Class submarines. 

Ground-Based Strategic Deterrent program will replace the nearly 60-year-old Minuteman III ICBM.

 B-21 Bomber will supplement the B-52 bomber and will have both conventional and nuclear roles. 

Long-Range Standoff Missile will replace the nearly 40-year-old Air-Launched Cruise Missile with a missile capable of penetrating defended airspace. 

Trident II (D5) Life Extension 2 Submarine-Launched Ballistic Missile Life Extension program extends the D5’s service life for deployment on both OHIO- and COLUMBIAClass submarines.

The National Nuclear Security Administration’s (NNSA) FY 2021 budget request for Weapons Activities is approximately $15.6B for nuclear modernization, sustainment, and operations. NNSA is responsible for the nation’s nuclear warheads and supporting infrastructure.

Spreading Hatred of the Faithful

This article was provided exclusively to the New York Analysis of Policy and Government by the distinguished Judge John Wilson (ret.), a former judge of the Criminal Court, New York City.

“Religions Harm People” is the title of a recent article in Verdict, an on-line magazine published by Justia  and from the first two sentences of her article, author Professor Leslie C. Griffin’s position is clear – “You may not want to hear that religions do a lot of harm.  But they do.”  She then proceeds to attack every position of the Catholic/Christian church that she believes to be anti-LGBTQ, anti-women’s rights, anti-reproductive rights, and in general, ignorant, antiquated and simply not progressive.

Professor Griffin is wrong.  In fact, her article exhibits no understanding of the origins of our rights, and our form of government.  Instead, Professor Griffin subjects the reader to the full force of her own hatred for those of the Christian faith.

From the outset, Professor Griffin makes a fundamental error with this statement regarding the “Shelter at Home” orders imposed by many states – “harm is apparent in the recent decisions by some churches to hold services even after a state has said it is dangerous for anyone to meet in person. The states passed stay-at-home or shelter-in-place orders to keep people safe.” (emphasis added.)

To understand why Professor Griffin is utterly incorrect, it is important to review the wording of both the Declaration of Independence and the First Amendment to our Constitution.

In the Declaration of Independence appear these immortal words – “we hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain inalienable Rights…that to secure these rights Governments are instituted among Men, deriving their just powers from the consent of the governed…”  Further, under the First Amendment, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.”   

By placing the authority of the State over religious expression, Professor Griffin has forgotten that our individual rights come from God, and not from the State, and that among those rights is the inalienable right to practice our religion as we see fit.  Further, the State only exists because it was created by the individual people who hold those rights, and we the people are only governed by our own consent.

These are the bedrock principals of our government, and the foundation of our Constitution.  No where is found the phrase, “unless the State decides that religion is harmful, and religious rights must give way to progressive ideals.”

No one questions the right of the State to protect the health and safety of the people.  As long ago as 1915, the US Supreme Court stated in Sligh v. Kirkwood, that “the power of the State to . . . prevent the production within its borders of…such articles as would spread disease and pestilence, is well established.”

In fact, where religious practices truly are harmful, the People have empowered the State to halt such practices.  New York, for instance, has codified its prohibition of female genital mutilation in Section 130.85 of the Penal Code, and specifically states, “no account shall be taken of the effect on the person on whom such procedure is to be performed of any belief on the part of that or any other person that such procedure is required as a matter of custom or ritual.”

While these federal guidelines are “advisory in nature,” the US Constitution is not.  All the federal COVID-19 response guidelines do is remind the states of what measures can be taken consistent with the law of our land.

Since Clergy are recognized to be “essential support,” the State cannot prevent the people from participation in clerical services.  Many States have asked clergy to minister to their congregations on-line or by videoconference, and many religious leaders have voluntarily complied with this request.

However, we have seen a number of tyrannical overreaches of the State encouraged by people with Professor Griffin’s views.  California has ordered the closure of all churches, deeming them to be an “unessential service,”  while the Mayor of New York, Bill DeBlasio, actually threatened to permanently close churches and synagogues that did not comply with his orders to remain closed. 

Some churches are making attempts at maintaining social distancing while still holding church services.  Yet in some jurisdictions these efforts have been viewed as a challenge to the State’s authority.  In Greenville, Mississippi, the parishioners who attended a “drive-in” church service at the King James Bible Baptist Church were fined $500 – yet, if they had parked in the lot of their local Walmart or liquor store, no fine would have been levied. 

In Louisville, Kentucky, Democrat Mayor Greg Fischer misused his police force to harass the parishioners of the On Fire Christian Church, who also chose to hold a “drive-in” service.  But Pastor Chuck Salvo did the next best thing to prayer in a situation like this – he hired a lawyer and sued Mayor Fischer.

In a strong victory for religious rights, Federal Judge Justin Walker came down hard on Mayor Fischer.  Quoting from the opinion, Judge Walker writes, “On Holy Thursday, an American mayor criminalized the communal celebration of Easter….the mayor’s decision is stunning.  And it is ‘beyond all reason’ ‘unconstitutional.’” 

No one disputes common sense measures to prevent the spread of a contagious disease.  But at the same time, citizens cannot allow their government, in particular their local and state officials, to take their God-given rights away from them under the guise of fighting a pandemic.  Indeed, people are afraid of getting sick and dying, or carrying the coronavirus back to our more vulnerable family members. Everyone needs to take appropriate precautions in an effort to halt this illness. However those reasonable efforts need not sacrificing our individual rights to the police powers of our elected leaders.

We must not let ourselves fall into the errors of a Professor Griffin, and either forget or willfully ignore from where our rights originate.  If we do, we then believe that the State is our master, instead of being our servant.  We let our own prejudices against religion and religious people rule our interpretation of the laws of our land.  And most dangerous of all to our freedoms, we encourage petty tyrants at the state and local levels to replace God with the State.

Despite the clear message that Speaker Pelosi and her Majority Leader Steny Hoyer essentially delivered, one that told the American people that their Representatives were more important than the citizenry they are supposed to serve, very little criticism, indeed, shockingly little, came from most of the media.

Clyburn meant the House Democrats’ attempt to take advantage of the crisis to shove frivolous expenditures into the $2.2 trillion CARES Act … When he introduced the CARES Act, Senate Majority Leader Mitch McConnell (R-Ky.) warned, ‘Any [spending] doesn’t address that pandemic … should not be considered.’ Despite that reasonable request, Rep. Clyburn and House Democrats leveraged the bill to include items like a $25 million bailout for the Kennedy Center, which subsequently fired its staff.’”

 A Federalist review of Speaker Pelosi’s actions in the first COVID legislative initiative, which was supposed to be bipartisan, found a stunning level of overtly political goals. In addition to intersectional aims, the bill tackles lofty climate change goals, demanding airlines “fully offset the annual carbon emissions … for domestic flights beginning in 2025” and giving passengers information “regarding greenhouse gas emissions resulting from each individual flight.” Meanwhile, because of the global pandemic this bill purports to address, the State Department has issued a Level 4: Do Not Travel advisory, the highest-level warning, which “advises U.S. citizens to avoid all international travel due to the global impact of COVID-19.” While Pelosi slides Green New Deal-like hokum into an urgent public health bill, most international travel has been halted, domestic air travel has become a “virtual shutdown,” and many cruise lines have canceled operations — making the green provisions even more impertinent. Further, the bill pushes collective bargaining for federal workers and changes to the IRS code for retirement plans for community journalists, two irrelevant points relative to the health crisis at hand.”

China’s Strategic Threat

The Chinese leadership has labeled the last two decades a “period of strategic opportunity” for the country. President Xi Jinping has, on numerous occasions, said that China must learn lessons from the collapse of Soviet Union to be a global power and that all options are on the table. In recent years, the CCP has dramatically increased its military spending, aggressive international behavior, and even shown its willing to export Chinese students to form the point of the spear, plunged in the heart of the west. The COVID-19 virus is renewing interest into China’s long-overlooked methods and goals. In the United States China is at its lowest level of popularity since the Tiananmen massacre in 1989.

Ninety percent of Americans in a recent PEW Research Center survey believe China is a threat, with well over 55% viewing it as a “major threat.” The danger is not new. In August 2018 Dr. Francis Collins, Director of NIH, wrote a letter to 10,000 research institutions in the US pointing out that “threats to the integrity of US biomedical research exist. NIH is aware that some foreign entities have mounted systematic programs to influence NIH researchers and peer reviewers and to take advantage of the long tradition of trust, fairness and excellence of NIH-supported research activities.” The FBI also is aware and responding, in part, by visiting colleges campus administrators to explain the reality of the threat it faces from its Chinese students and to request their assistance. Yet, somehow, over the last few decades the US Government continues to allot more visas to Chinese students than to any other nationality; and most of those are granted to STEM majors. 

What is the problem and how can the US identify the underlying causes of the threat to US national security and to the American economy? This is the question that Washington should be addressing in 2020. 

Although China conducts a highly-sophisticated, cyber warfare program, Chinese intelligence still operates using a shotgun approach on American college campuses. The concept is that the more “nodes,” in this case Chinese students,  spread across America the better the odds of Beijing receiving actionable intelligence. Each Chinese student is a potential “access agent,” or covert influencer. As a Chinese intelligence official told me long ago, one grain of sand is not an irritant and it doesn’t form a beachhead, but a million grains of sand, that is something to stand on. Although most Chinese students entering the US are here for legitimate educational purposes, they still form a beachhead of 800,000 F, M, and J visa-holding individuals obliged to their homeland.

In any given year, an average of a half million Chinese are studying on American campuses and working in American research labs. In FY 2019 alone Chinese nationals were granted 117,000 F visas. Most Chinese students come to the US with no plans to work for Chinese intelligence, but all are well aware of what their government expects from them. The COVID-19 pandemic put the world on “pause” for the moment. It may the West’s last opportunity to address the Chinese student threat.
