Drastic Cuts for Sick 9/11 Responders and Survivors

More Than Half of the 10,000 WTC Victims Diagnosed with 9/11-Related Cancers Will now get 50% to 70% Less Compensation.

Thousands of people who breathed in the World Trade Center toxic dust have been getting sick at alarming rates because of their exposure to deadly World Trade Center toxins. The Victim Compensation Fund (VCF), which has been providing financial help to thousands of injured and ill 9/11 responders and survivors, recently announced cuts in pending claims of 50%, and cuts in future claims of up to 70%. This means that thousands of people in the 9/11 community, who live in every state, will not get the full compensation they were expecting and deserve. Worse still, if Congress does not act, thousands more who are diagnosed with 9/11 related cancers will be denied any compensation since the VCF is set to expire at the end of 2020.

And, many who have received awards will also be shut out if and when they are found disabled, or diagnosed with new illnesses in the future. These drastic cuts will also affect those who pass away from their WTC-linked illnesses.

Tens of thousands are being penalized merely because their illnesses were diagnosed later than an arbitrary date set by the VCF, or because it took the WTC Health Program months to certify their illnesses.

Congress and the Centers for Disease Control and Prevention (CDC) simply didn’t anticipate the explosion of cancers and deaths caused by the WTC toxins. And, as a result, they didn’t set aside sufficient funds.

We have not forgotten that it was the Federal Government that assured us just days after the attacks that the “air was safe to breathe”. Federal and local officials pushed aggressively to reopen the financial markets, get businesses back up and running, and eventually provided incentives for people to move into the area.

My law firm’s client NYPD James Zadroga’s autopsyproved that it was anything but “safe”. When he died of pulmonary fibrosis in 2006, an autopsy revealed ground glass, asbestos, chromium, lead, and benzene – all known carcinogens – in his lung tissue. That was the evidence that the National Institute for Occupational Safety and Health (NIOSH) and the C.D.C. needed to link 68 cancers and a host of respiratory illnesses to the WTC toxic dust.

Now, those very Americans who believed the Government are having the rug pulled out from under them yet again with this recent devastating news. Cancer certainly won’t stop afflicting the 9/11 community any time soon, and especially not on its current expiration date of December 18, 2020. We won’t stop fighting until those who receive reduced awards are made whole, and those who get sick in the future are allowed to make a claim. No one should be denied full benefits!

The fund must be extended.

All of us in the 9/11 community can help. Please tell your representatives in Washington to vote in favor of the extension. Visit the Citizens for the Extension of the Zadroga Act website to find out if your Member of Congress is planning to support injured 9/11 Responders and Survivors, and is planning to be a co-sponsor of the legislation to fully fund and extend the VCF. If they are, thank them for supporting 9/11 responders and survivors. If not, tell them that you are one of their constituents and you need them to sign on.

Injured 9/11 responders, survivors and their families do not need speeches, they need action. “Remembering 9/11” should be more than a bumper sticker.

Here are the sobering statistics:

  • Over 10,000 people have now had their cancers certified as 9/11-illnesses, and
  • Over 2,000 people in the 9/11 community have died from their WTC illnesses.

Nearly 100,000 people have signed up with the health program and it has been providing free health care to those who need it. So far the VCF has awarded over $5 billion to more than 25,000 people.

The stakes are enormous. Cancer doesn’t just kill people. It can also bankrupt families. A cancer diagnosis often results in substantial costs for health care and lost wages, as well as physical and emotional hardships that are difficult for any individual or family to handle even under the best of circumstances.  

All those who were present are at risk. I urge everyone who was exposed to the WTC toxins to register with the health program which is in all 50 states. Those who are certified with physical illnesses, they are eligible to receive compensation from the VCF.  

Both registrations should be done as soon as possible. There are long backlogs to get into the health program and the VCF is set to close next year.

President Obama’s Failed Terrorism Policies

The New York Analysis concludes its report on President Obama’s approach to terrorism

The Results of President Obama’s policies have been disastrous

ISIL has conducted attacks ranging in tactics and targets—the bombing of a Russian airliner in Egypt; the attacks in Paris at restaurants, a sports stadium, and a concert venue; the killing of hostages and Bangladeshi law enforcement officials in a café in Bangladesh; and the bombing of a crowded commercial district in Baghdad—all of which demonstrate how ISIL can capitalize on local affiliates on the ground for attacks.”

The day before President Obama took the Oath of Office in his first term, Iraq was a nation slowly moving towards a stable democracy, despite the existence or numerous challenges. Obama’s Failed Approach to Terrorism

The New York Analysis of Policy & Government presents a two-part series on how President Obama has fared in the fight against terrorism.

The lessons of the Islamic extremist’s attacks of September 11, 2001 have not been learned by the Obama Administration, or western progressive politicians.

Fifteen years after the most devastating assault on the U.S. homeland in American history, the same errors, misconceptions and failed practices that led to the attack are being repeated, both by the White House as well as by some experts who have published studies of the issue.

The faulty logic of many western leaders ignores reality, including:

The actions through drone attacks, special forces operations and other means to eliminate or capture terrorists leaders are a necessary part of fighting terror, but only a small part.  Demands that captured terrorists should be given a trial or a fixed prison sentences ignores the reality that a true war exits. Most importantly, the concept that law enforcement through prisons or executions as a way to deter future crimes hasn’t worked. Bin Laden is dead, but his work goes on. Terrorists freed from Guantanamo re-enter the fray with distressing regularity. In his 2015 State of the Union Address, Mr. Obama stated that “The Shadow of the Crisis of Terrorism has passed.” There was not a shred of evidence to support his statement, not then, not before, and not since. It is not inconceivable that he based his comments on the fact that some key leaders, such as Bin Laden, had been killed.  A failure to realize the true nature of the threat has led to exceptionally serious policy errors, including the premature withdrawal of American troops from Iraq, which allowed ISIS to thrive and grow.  ISIS’s rise to a self-proclaimed “Caliphate” controlling more territory than ever by a terrorist organization indicates the true nature of the crisis.  Islamic terrorism isn’t a criminal justice issue, it’s a national security challenge.

Fighting a war requires constant vigilance and decisive action, but in the mindset of both President Clinton, whose missteps allowed Bin Laden to survive after his first attack on the World Trade Center, and President Obama, who changed the nature of America’s mindset from fighting a war to dealing with crimes, the problem is more akin to a criminal prosecution that can be engaged in with slow deliberation.

What Happens if America Loses in Afghanistan

The President’s decision to allow 8,400 U.S. troops to remain in Afghanistan until next year is a recognition of the extraordinary harm that would result if the mistake he made in Iraq is repeated.

Mr. Obama’s total withdrawal of all U.S. troops in Iraq led to the disaster in Iraq, the rise of ISIS, general turmoil throughout the Middle East, and an escalation of worldwide terrorism. The result of withdrawing from Afghanistan while the Taliban is increasingly resurgent would be equally devastating.

While American troops could not remain in Afghanistan indefinitely, progress achieved before the current administration has been jeopardized by a series of poor decisions by the Obama Administration, including the opening of negotiations with the Taliban in violation of long-standing American policy of not negotiating with terrorists, and, against military advice, the announcement of a withdrawal date. The Obama White House has clearly renounced the goals candidate Obama announced “This is not a war of choice. This is a war of necessity. Those who attacked America on 9/11 are plotting to do so again. If left unchecked, the Taliban insurgency will mean an even larger safe haven from which Al Qaida would plot to kill more Americans. So this is not only a war worth fighting; this is a – this is fundamental to the defense of our people.”

While the decision is appropriate, it may not be sufficient.

Off the record conversations by the New York Analysis with individuals who have been part of the U.S. effort in Afghanistan have indicated that during the Obama presidency the fight against the Taliban has been plagued by shortages of equipment, the forced layoffs of key officers, and the general reduction of funding for the U.S. military.

In 2014, notes the BBC,  Taliban leaders declared “victory” as NATO withdrew its (mostly American) forces, leaving only a residual training force. The potential to reduce the Taliban to relative impotence was eliminated in 2012, when America abandoned its policy of not negotiating with terrorists and the White House outlined a policy goal that discarded the prior Administration’s reasoning for entering into the conflict in the first place.

The Taliban resurgence could be halted through greater U.S. emphasis on fulfilling original goals such as insuring fair elections, and economic development of areas beyond the Taliban’s control. But a military option—similar to the 2007 “surge” in Iraq that produced outstanding results (which were destroyed as a result of the Obama pullout) remains the most important. The 8,400 troops will not accomplish that goal.  It prevents an immediate disaster but leaves the hard decision-making to the next President.

The CFR study suggests that  “The United States could halt further reductions—or even increase—the number and type of U.S. forces in Afghanistan. These forces can train, advise, assist, and accompany Afghan forces and conduct direct-action missions; supplement Afghan forces with more intelligence, surveillance, and reconnaissance enablers; and increase close air support. The United States could also broaden U.S. counterterrorism legal authorities to proactively target the Taliban and Haqqani network. At the moment, U.S. forces can only target al-Qaeda and ISIL-KP operatives in Afghanistan, except in situations where extremists are plotting attacks against U.S. or other international forces or during in extremis cases where the Afghan government requests U.S. aid. The United States could also increase the authority for U.S. forces, particularly conventional forces, to train Afghans below the corps level.”

It is fully understandable that after so long the American public would be weary of the effort in Afghanistan. But the results of a Taliban resurgence should also be realized. The Taliban played a key role in the 9/11 attacks, and would commit vast new resources if power is regained in Afghanistan. The influence that would be gained in neighboring Pakistan would be dramatic. A complete takeover of that government would give the terrorists access to the Pakistani nuclear arsenal.

The time has come to question the monumental incoherence of those who weaken the nation by reducing key defense programs, withdrawing American forces from hotspots, or handcuffing those who seek to gain the information needed to prevent another terrorist assault.  Many of the same individuals in government and the media who scream and protest about nonlethal interrogation practices such as waterboarding have said far less in reaction to the beheadings, rapes, and wholescale  murders committed by those who seek every opportunity to kill as many innocent Americans as they can.

Their so-called moral arguments are baseless.  There is general agreement that eliminating terrorist leaders, including traitorous U.S. citizens, by drone attacks are justified (and it is indeed appropriate.) But why then do they question nonlethal interrogation practices that do not cause any permanent harm? Are their sensibilities so delicate that they would prefer to chance another 9/11 rather than to authorize harsh questioning?

Any government official who would prefer to jeopardize innocent lives rather than permit harsh but non-injurious interrogation is unfit for office. The fact that Feinstein’s hearing is being accompanied by the release of the names of those involved further impairs the ability to keep Americans safe, and punishes those who are merely seeking to keep the U.S. secure. Intelligence officials and other absolutely refute Feinstein’s unsupported contention that these interrogations did not yield vital information.
