U.S. Department of Commerce Further Tightens Cuba Sanctions

The Bureau of Industry and Security (BIS) of the U.S. Department of Commerce has announced that it will further restrict the Cuban regime’s access to commercial aircraft and other goods. According to Commerce. “This action supports the Administration’s earlier decision to hold the Cuban regime accountable for repressing its own people as well as continuing to provide support to the illegitimate Maduro regime which has terrorized the Venezuelan population and wantonly destroyed the once-prosperous economy relied on by millions. This action by the Commerce Department sends another clear message to the Cuban regime – that they must immediately cease their destructive behavior at home and abroad.  Commerce Secretary  Wilbur Ross noted that “The Trump Administration will continue to act against the Cuban regime for its misdeeds, while continuing to support the Cuban people and their aspirations for freedom and prosperity.”

Commerce reports that “In order to generate revenue for its illicit activities, the Cuban regime is resorting to transporting tourists on leased aircraft subject to BIS jurisdiction. Consequently, BIS is revoking existing licenses for aircraft leases to Cuban state-owned airlines, and will deny future applications for aircraft leases. Additionally, BIS is expanding Cuba sanctions to include more foreign goods containing U.S. content, and is imposing additional restrictions on exports to the Cuban regime.”

Turkey Ceasefire

On October 18, Vice President Pence announced an agreement between the United States and Turkey to establish a ceasefire in Northeast Syria. As a result, Turkey has agreed to pause its offensive operations in Syria for 120 hours to allow for the withdrawal of the Peoples Protection Units from the roughly 20-mile safe zone along its border. Upon completion of the YPG withdrawal, Turkey has committed to enacting a permanent ceasefire.

Defense Secretary Esper spoke with the Turkish Minister of Defense. He reiterated the United States’ position that Turkey must adhere to the full terms of this agreement, and that Turkey is expected to ensure the safety and well-being of all people in the area controlled by Turkish Forces. Protecting religious and ethnic minorities in the region continues to be a focus for the Administration. This ceasefire is a much needed step in protecting those vulnerable populations. Esper  reminded Turkey about its responsibility for maintaining security of the ISIS detainees located in the affected areas.

Esper noted that “The United States is continuing our deliberate withdrawal from Northeastern Syria as previously announced. The force protection of our service members remains our top priority, and as always, U.S. forces will defend themselves from any threat as we complete our withdrawal from the area. No U.S. ground forces will participate in the enforcement of this safe zone, however, we will remain in communication with both Turkey and the SDF.”

When I last visited Latin America in April, I explained the Trump administration’s ultimate goal in the region, which is to cement a future of democracy, peace, and prosperity.

As I said then, it’s not an impossible dream.  Nor it is a foregone conclusion. We will all have to work on this together.

Colombia is proof – is proof that the dream is indeed possible and that hard work pays off.  And today, that work continues.

Russia Holds Major Military Drills

Russia has conducted the second of two major military operations this Fall.

Congressional Democrats have devised yet another way to separate Americans from their money. They’ve named their proposal, “Treat Wealth Like Wages,” (TWLW) and despite their claim that they want only to “level the playing field” by taxing rich wealth creators, the real victims could be middle income people.

The plan, the brainchild on Oregon’s Ron Wyden, the top Democrat on the Senate’s Finance Committee, would tax not only one’s income, but also any accrued wealth. Proponents, including many in the mainstream media, are singing the plan’s praises because it would increase capital gains on millionaires and billionaires and raise two trillion dollars in the process.

The plan is wrong for many reasons, not the least of which is that it would discourage investment. Why penalize those who are savvy enough to invest their savings in order to earn more money? The rich will always find a way to avoid having their wealth stolen by government.  The less-well-healed have fewer options.

The proposal is getting plaudits from the usual quarters.  From Liberty Planet: “The President of the Center for American Progress Action Fund describes Treat Wealth Like Wages as a “bold solution that would reduce inequality.” Professor Lily Batchelder of the NYU School of Law boasts that the additional money generated by the new taxes on the very rich could “level the playing field.”

 Americans are already overburdened with taxes and fees and another onerous money grab would be the straw that breaks the camel’s back. Time to curb Leviathan’s appetite and rein in government’s habit of reaching into the pockets of wealth creators in order to expand the welfare state.

The Left’s Ft. Sumter Moment

Has the U.S. Progressive/Left reached its Fort Sumter moment?

Significant conflicts in history rarely spring forth from a singular incident. Rather, what is seen as an incendiary event is in reality the accumulation of disputes that have led to a flashpoint. Firing on Fort Sumter, which began the Civil War, was the end result of a century-old debate on human bondage. Similar to the newborn Confederacy’s advocacy of that horrible practice, the Left’s disdain for individual rights and American sovereignty has led to the current, stunning split in U.S. politics.

For most of American History, apart from the terrible aberration of slavery that precipitated the War Between the States, the concepts of personal freedom and the nation’s national dominion over its own territory reigned supreme. The trend had consistently been towards enhancing individual liberty, from the ideas expressed in the Declaration of Independence, to the adoption of the Bill of Rights, the ending of slavery and segregation, and the extension of voting rights to all adult citizens. 

 Despite substantial disagreements between Democrats and Republicans, liberals and conservatives, broad agreement on those topics prevailed. But a new and rather alien influence has entered national politics, one which threatens to rend the nation apart and disassemble the Constitution. Progressive/Left actions over the past several years constitute a political assault, a Fort Sumter moment, against the United States both as a physical nation and as a Constitutional government.

Consider the totality of what Progressives advocate, and what they do. As reported in the Free Beacon, Democratic National Committee chair Tom Perez has called the extremist radical Congresswoman from New York, Alexandria Ocasio-Cortez, “ “the future of the party.” If so, her views on the issues are a source of deep concern.  She opposes free enterprise, believing that “Capitalism can’t be redeemed because of the profit motive.” She wishes to endanger national security by slashing U.S. defense spending to dangerously low levels, and bringing all U.S. troops home. She essentially advocates open borders, and the misuse of American tax dollars to provide benefits to those entering the nation illegally. 

Leftist politicians in “sanctuary cities” openly seek to prevent the enforcement of federal laws on immigration, even against thse illegals who have commited crimes against American citizens.  Progressive judges, particularly in the Ninth Circuit, have frequently placed their left-wing views above Constitutional or statutory law. Throughout universities and the educational establishment, students with centrist and conservative views are openly penalized and intimidated for their beliefs.

The problem isn’t limited to politicians. Robert Knight, writing in the Washington Times, explains: “…cultural Marxists advance their doctrines and silence any dissension…” A senior social media manager has called for imprisoning President Trump, apparently for merely having beliefs that differ from the Left.  Facebook, Twitter, and Google have all, to varying degrees, suppressed non-Leftist users.

It’s more than just words. The Washington Post notes that Missouri Democrat State Sen. Maria Chappelle-Nadal has called for the assassination of President Trump (under pressure, she later relented.) Across the nation, many on the left consider it appropriate to physically assault individuals for expressing contrary opinions.  Progressive elected officials, such as Portland, Oregon’s Mayor Ted wheeler, have discouraged police from protecting those assaulted by Antifa, a recent example being journalist Andy Ngo.

Antifa supporter Willem Van Spronsen, armed with incendiary devices and a firearm attacked an Immigration and Customs Enforcement Center. The attack itself is only part of the issue.  The praise and support he has received for his assault on a law enforcement agency is the key, and vastly disturbing, issue. 

The initiation of violence and rioting by those who disagreed with the election results of 2016 was condoned and excused by Progressives and leftists.  Those acts were not the results of any particular policy or act of the President. I was in Washington, D.C. just before the inauguration, before Donald Trump was even sworn in.  The violence was already underway. 

This is not politics as usual; it is far darker.  This is insurrection, a replay of the attack on Fort Sumter.

THE “CHURCH” OF CLIMATE CHANGE, Part 2

In an extensive article published by Tablet, PhD candidate Zach Golberg discusses the “woke” phenomenon prevalent among white liberals in particular.   Being “woke” is a term that derived from African-American culture (an issue which, if considered more than momentarily, would leads us down the rabbit hole of cultural appropriation, if we allow it to), and is broadly defined as “being aware of social justice issues” (it should be noted that the term is also defined by the Urban Dictionary as  “self righteousness masquerading as enlightment.”)  

                While Goldberg’s article is mainly addressed to the paternalism of white liberals towards minority Americans, it is a must-read for anyone wishing to understand the behavior of these same white liberals when it comes to their support for climate change, and why they allow for no dissent on this, and many other issues. 

                According to Goldberg’s research, “White liberals make up 20-24% of the general population but, for a multitude of reasons, exert an outsize political and cultural influence. They are more likely to consider themselves activists, are more active on social media, and, significantly, they are one of the most affluent groups in the country… ‘woke’ white activists…have had their perceptions distorted by social media-tinted caricatures that obscure more objective measures of reality… these moral emotions become hyperactive and detached from objective reality; when they motivate the division of society into ‘allies’ and enemies; and when they generate a level of sanctimonious outrage and judgment that places all political dissent beyond the pale.”

                Goldberg’s insightful analysis continues: “For the woke and their allies, these rapid changes are heralded as signs of progress, leading at times to harsh criticism of anyone who would stand in their way. This ideological stridency and triumphalist attitude can be powerful weapons against political opponents but are alienating—perhaps deliberately so—to moderates and conservatives…The woke elite act like white saviors who must lead the rest of the country…to a vision of justice the less enlightened groups would not choose for themselves.” (emphasis added)

                Goldberg supports his interpretation with a host of data, including a 2018 survey conducted by the American National Elections Studies.                 Again, Goldberg’s analysis is intended to explain white liberal attitudes to issues of racial justice.  But his conclusions can be applied to assist in understanding the truly obnoxious attitude of climate change true believers, and their unwillingness to countenance any questioning of their orthodoxy.  

                Much like the child who now leads them, the Church of Climate Change cannot countenance any questioning of their sacred beliefs, and will tolerate no opposition to their efforts to save humanity from itself.  Is there any answer to dealing with such inflexibility? To paraphrase Professor Farnsworth from Futurama – “Only Science can help us now!”

The “Church” of Climate Change

                Recently, 16 year old Swedish climate “activist” Greta Thunberg came to New York to lead a “climate strike” day of protests.  Thousands of New York City Public school students attended the rally, having been excused from school for the purpose of protesting.  In a display of their usual efficiency, however, the New York City Education Department would not give teachers the day off, leaving many children in attendance at the rally without adult supervision.

                Thunberg became famous last year for beginning a one-person walk out from her school, stationing herself in front of the Swedish Parliament.  Since then, she had become the youthful face of the “climate change” movement, and the subject of fawning articles by MSM sources like CNN, which claims that when Thunberg testified before the House Foreign Affairs Subcommittee on Climate, “the smallest and youngest person in the room came off as the oldest soul on Capitol Hill.” 

                The vehemence with which the topic of climate change is discussed by its adherents is nothing less than Messianic.  In her speech to the British Parliament, Thunberg said “I was fortunate to be born in a time and place where everyone told us to dream big; I could become whatever I wanted to… You lied to us. You gave us false hope. You told us that the future was something to look forward to… Around the year 2030, 10 years 252 days and 10 hours away from now, we will be in a position where we set off an irreversible chain reaction beyond human control, that will most likely lead to the end of our civilisation as we know it…”  

                Compare Thunberg’s statement with this quote from 2 Peter, 3:10 – “But the day of the Lord will come like a thief. China is providing the United States and other nations critical components for military weapons and equipment, according to a White House study released Friday.

THE ON-GOING WAR AGAINST THE CATHOLIC CHURCH IN AMERICA

This article was prepared exclusively for the New York Analysis of Policy and Government by the distinguished retired judge John Wilson.

The allegations are nothing short of horrific.  Over the past 50 years, if not longer, Catholic priests across the nation engaged in sexual activity with young children, most of whom they were responsible to supervise from a position of authority over these same children.  Recently, in New Mexico, former priest Arthur Perrault was sentenced to 30 years in prison for the abuse of an altar boy who was just 10 years old when the abuse began.    This August, another priest was convicted of sexually assaulting two girls, age 9 and 13, in Washington DC. 

                There is also no dispute that for many years, the Catholic Church in America did nothing to prevent incidents like these, except to move the offending priest from one parish to another.  As long ago as 2002, the Boston Globe reported that approximately 70 Boston-area priests had been accused of sexual abuse.  “Many of these abuse cases were known to the offending priests’ superiors. In several instances, church superiors had moved offending priests to other parishes — where they would remain in daily contact with a new batch of children — rather than punish them internally or report the cases to civil authorities.”

                There is no defending or justifying this abuse of the trust Catholic parents had placed in their spiritual leaders.  In fact, both Pope Benedict and Pope Francis have repeatedly asked for the forgiveness of the victims of the abuse.    But many victims are not in a forgiving mood.

                These victims have found a friend in the New York State Legislature, who recently enacted the Child Victims Act, which not only extended the age by which a person can bring criminal charges for a sexual assault that occurred before they were 18 years old, but also literally revived time-barred civil claims by persons who failed to bring lawsuits during the applicable limitations period. 

                In other words, in New York, you now have a year and a half to bring a lawsuit and allege sexual abuse when you were a minor, irrespective of when that abuse occurred.

                Though this may sound like an attempt to give these victims a measure of justice, the practical effect of this change in the law is more insidious.  As a lawyer, the question of proof regarding the allegations made by someone alleging an incident that may have happened in 1965 is of great concern.  Supposed the alleged abuser is dead, or incapable of giving testimony in his defense?  What physical evidence for the allegations made by the abused can be presented to a jury?  Is the alleged victim to be taken at their word alone, or would the testimony of a psychologist be sufficient proof, even if that testimony is based upon information received solely from the plaintiff?  Is the mere fact that the abused was a student of the abuser, or an altar boy, or attended the same parish as the abuser 30 years ago sufficient to establish the allegations made by the abused?

                Though questions like this may concern me, they do not appear to be of concern to the lawyers bringing the revived lawsuits against the Catholic Church.  At last count, almost 400 cases have been brought in New York State since the Child Victims Act was enacted in February, 169 of those claims filed in New York City alone.  CNN reports that the law firm of Weitz and Luxenberg has 1,200 clients in New York State awaiting their turns to file.  

                In September of this year, 10 lawsuits were filed against the Diocese of Brooklyn for abuse that is alleged to have occurred between the 1950’s and the 1980’s.  One of those accused is alleged to have committed his crimes in the 1970’s, however, a previous investigation of the claim by the NYPD ruled the allegations “unfounded.”  This hasn’t stopped this same claimant from filing suit against the Church under the new law.  

                The practical effect of a change in the law such as this is to create a floodgate of litigation that is difficult to prove, and even more difficult to defend against.  Anticipating catastrophic financial loss, several Catholic Dioceses have sought the protection of the bankruptcy courts, including the Archdiocese of Rochester, NY  and the Archdiocese of New Mexico.  In fact, since 2004, 19 Dioceses and Archdioceses have filed for bankruptcy in the face of litigation brought by abuse survivors. 

                Perhaps this is what many of the lawyers and their clients intend.  A profile of Minneapolis Attorney Jeff Anderson, who is estimated to have earned “hundreds of millions” of dollars by suing the Catholic Church, is unflatteringly described in this fashion: “Civil attorneys like Jeff Anderson…meet with someone for a few minutes, lump allegations together, throw lawsuits at the wall, and see what sticks. In the meantime, men’s lives are being ruined. They don’t care. And if they say they know that everyone they have targeted is guilty, they’re lying to you or to themselves.” 

                This concerted and years-long attack on the Catholic Church in America has amounted to a war, and it is a war the Church is losing.  Is it the intention of those lawyers and victims waging this war to drive the Church “out of business?” 

                Only the attorneys bringing the cases against the Church can explain their own motives. Attorney Eric MacLeish, who brought a series of high-profile cases against the Archdiocese of Boston beginning as early as 1992, has stated that though he himself was a victim of sexual abuse when a child, the litigation he brought against the Church is “no crusade. I’m not getting back at people because of what happened to me as a young man. There is no private vendetta going on here.”   

But at the same time, when MacLeish was accused of making prejudicial comments to the press regarding the former Cardinal of the Archdiocese of Boston, Bernard Law, MacLeish reportedly made the following statement, ”If they want a war, they’re going to get one.”

                If we are to judge those bringing these lawsuits by their actions, and not by their conflicting words, then their intentions are clear – it’s a war on the Catholic Church in America, and at this stage, where there appears to be very little effort made to determine which allegations are truthful, and which are motivated by other reasons, its shoot first, and ask questions later.

Even after the House Intelligence Committee issued its majority investigative report concluding that it had all been a hoax, Schiff announced, ‘I can certainly say with confidence that there is significant evidence of collusion between the campaign and Russia.’ He produced no such evidence, because it did not exist. But that did not stop him from perpetuating the “collusion” delusion. On CBS’s Face the Nation, he ventured that Trump ‘may be the first president in quite some time to face the real prospect of jail time.’ Schiff was so heavily invested in the scam and the celebrity it brought him that there was no reversing course. Maybe a part of him really believed his claims, and he was hoping that some magical revelation would appear out of nowhere to vindicate them. Like a guy with a counterfeit bill, he kept trying to pass it off to others.”

Democrats previously initiated an impeachment inquiry, which leads to one of the most serious, constitutional duties of Members of Congress: removal of the President of the United States. Through this process, if the President has committed high crimes or misdemeanors, Congress may overturn the election of the President and the will of the American people. It is therefore inexcusable to toy with the process and mislead the American public with such a statement.”

Because expelling members of the House and vacating the Speaker’s Office are considered matters internal to the House, they do not require the consent of the Senate or the President.
